Any print copies sold to third parties must clearly show Licenser's copyright notice and contain a statement that the pattern is for personal use only. Licensor does not give you permission to sell these Patterns in any other form or manner including, but not limited to, off the Internet. You may not modify, transmit, create derivative works from, display, or in any way exploit any of the contents, in whole or in part for resale purposes other than as authorized above. 2. ) Licenser's Rights. You acknowledge and agree the Patterns are proprietary products of Licensor protected under U.S. copyright law. You further acknowledge and agree that all right, title, and interest in and to the Patterns, including associated intellectual property rights, are and shall remain with Licensor. This Agreement does not convey to you an interest in or to the Patterns, but only a limited right of use revocable in accordance with the terms of this Agreement. 3. ) Federal law provides severe civil and criminal penalties for the unauthorized use of copyrighted works,including patterns.It is the policy of The Berry Basket ( Great American Scrollsaw ) to prosecute all copyright violators and to recover all illegal profits plus damages. 4. ) Termination Without Prejudice to Any Other Rights. Licensor may terminate this Agreement if you fail to comply with the terms and conditions of this Agreement. In such event, you must destroy all copies of the Patterns. 5. ) Disclaimer of Warranty. THE PATTERNS AND CD's ARE PROVIDED "AS IS." LICENSOR DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE PATTERNS. LICENSOR MAKES NO WARRANTIES, EXPRESS OR IMPLIED, AS TO TITLE OR INFRINGEMENT OF THIRDPARTY RIGHTS, MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE. 6. ) Limitation of Liability. In no event shall Licensor be liable for any indirect, "incidental," consequential, special, or exemplary damages or lost profits even if Licensor has been advised of the possibilities of such damages.
